TERMS OF BUSINESS

The terms below will apply to your booking so please read them carefully and let us know if you have any questions.

 

1 Your contract with us

1.1 Your contract is with us, The Flint Mill in Stone, a trading name of Dora Appleby of The Flint Mill, Mill Street, Stone, ST15 8BA. 

 

2 Making your booking

2.1 You may request a booking in person, by telephone, or in writing by email or post.

2.2 You must be at least 18 years old. 

2.3 You may only make a booking on behalf of someone else if you are authorised to do so and provided that you agree to be responsible for that person's compliance with these terms as if they were the person making the booking.

2.4 Bookings are non-transferable

2.5 A contract is only formed between you and us when we accept your booking request. 

2.6 If you have any special access requirements please let us know at the time of booking. We will endeavour to accommodate your requirements, but our ability to do so is dependent on what these are and on the availability of suitable accommodation. The guest suite is located on the first floor of the building and is therefore unlikely to be suitable for wheelchair users.

2.7 We reserve the right to ask you to pay some or all of the price of your booking in advance.

 

3 Prices

3.1 The price for the suite per night (except in the case of obvious errors) is as advertised on our web site (www.theflintmillinstone.co.uk) at the relevant time, unless we notify you of a different price at the time of your booking.  Unless stated otherwise, all charges are inclusive of any VAT which may be applicable at the date of your stay. 

3.2 The price includes overnight occupancy of the suite by two adults. No more than two adults may occupy the room. 

 

4 Payment

4.1 Unless agreed otherwise at the time of your booking you will be invoiced for the first night of your intended stay at the time of booking and this can be paid online by bank transfer, PayPal or most credit/debit cards. Cheque payment is also acceptable providing that it is received at least 10 days prior to the date of your intended arrival.

4.2 The balance of any amounts due is payable in full on your scheduled day of departure in cash, by cheque or most credit/debit cards.

4.3 By entering into a contract with us, you accept responsibility for paying all charges due to us under the contract. By providing your credit/debit card details to us when making your booking you are irrevocably authorising us to debit your card by the amount of this charge (and any other charges due to us under this contract).

 

5 Check in and check out

5.1 The suite will normally be available for you from 16:00 on your scheduled day of arrival.  Please let us know your likely time of arrival so that we can make sure someone is available to check you in. 

5.2 Unless we specifically agree otherwise with you, you must vacate the suite by 10:00 on your scheduled day of departure If you do not do so, you will be charged for one further night's accommodation.

5.3 Room and gate keys must be returned through the main letter box on departure. If you do not return these you will be charged for the cost of changing the relevant locks.


6 Cancellation by you

6.1 Should you cancel your booking before 15:00 at least three days prior to your scheduled date of arrival we shall refund any prepayments that you have made less a deduction of £10.00 to cover administration and credit card charges provided that you make the cancellation in writing in accordance with paragraph 19.4 .

6.2 If you do not cancel your booking in accordance with paragraph 6.1, or if you do not take up your booking, you will be charged for one night's accommodation.

 

7 Cancellation by us

7.1 In the unlikely event that we need to cancel your booking (for instance, family illness or bereavement) we shall reimburse any prepayments that you have made and will attempt (but not be liable nor obliged to) locate alternative accommodation.

 

8 Insurance

8.1 We recommend that you take up suitable travel insurance to cover any cancellation, curtailment, and loss of baggage, personal effects and money.

 

9 Children

9.1 There is no provision in the suite for accommodation of children.

 

10 Smoking

Smoking is not permitted in the building. There are smoke alarms in all rooms. If you smoke in the suite or outside with the door open you will be charged an additional £100.00 on departure.

 

11 Behaviour
11.1 We reserve the right to judge whether your behaviour is acceptable during your stay. In the event of your failure to comply with any reasonable requests to correct this unacceptable behaviour we may terminate the booking immediately without being liable for any refund or compensation. 

 

12 Animals

12.1 We regret that with the exception of guide dogs, hearing dogs and other assistance dogs, no pets or other animals are allowed in the suite.
 

13 Our liability to you

13.1 Subject to paragraph 13.2, our total liability to you for any loss you suffer will be limited to the total price of your booking.  We will not be liable for any losses which were not reasonably foreseeable to both you and us when the contract was entered into, or for any losses that were not caused by any breach of contract or breach of statutory duty or negligence on our part. We shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contract with you that is caused by events outside our reasonable control (such as serious damage to our premises, serious adverse weather conditions, a pandemic or epidemic, or interruption or failure of utility services such as electric power, gas or water).

13.2 Nothing in these terms excludes or limits in any way our liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or for any other matter for which it would be illegal or unlawful for us to exclude or limit (or attempt to exclude or limit) our liability.

 

14 Your liability to us

14.1 In addition to your contractual liabilities set out in these conditions, you will also be liable for any damage you cause to the suite or to other parts of our property or any fixtures and fittings thereon. 

15 Discrimination
15.1 It is our policy not to discriminate on the grounds of race, colour, nationality, creed, sex, marital status, age, ethnic origin or disability. You are also expected to adhere to this policy during your stay.

 
16 Comments and complaints
16.1 We hope that your stay is very enjoyable and that you find all our services to be of a good standard. However, should you have any cause for comment or complaint, please let us know as soon as reasonably possible during your stay so that we can try and resolve the issue immediately.

 
17 Statutory requirements
17.1 We are subject to statutory controls, including those relating to fire, health, hygiene and safety. You are also expected to comply with these requirements during your stay.

18 Data protection
18.1 We respect the privacy of every individual who visits our website. The data collected about you will be used firstly to fulfil any service you might request and secondly to improve our service. We will under no circumstances give your personal data to third parties and will, if requested in writing, destroy your data unless required by law. When paying for a booking, your credit card or billing account details are only retained for the purpose of handling that individual transaction and will be destroyed on your departure.

 

19 General

19.1 Any error or omission in any information or document issued by us shall be subject to correction provided that the correction does not materially affect the contract.

19.2 If any court or competent authority decides that any of the provisions of these terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

19.3 No person who is not a party to our contract with you shall have any rights under or in connection with it.

19.4 All written communications by you to us must be sent by post to The Flint Mill, Mill Street, Stone, ST15 8BA or by e-mail to theflintmillinstone@gmail.com (or to such other address that we may notify to you).  We may send written communications to you at either the e-mail or postal address that you provide at the time of booking. 

19.5 These terms shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English courts.
